Introduction

Florida Statutes provide for the filing of certain other public records with the Clerk of Circuit Court’s office. The following links provide access for searching these records. 

Civil Miscellaneous

This grouping includes the following types of records filed with the Clerk’s Office as provided by the cited Florida Statutes.

Vehicle Repair Dispute (FS §559.917) and Release of Vessel (FS §713.76)
Disputes over unauthorized repairs to a vehicle by a motor vehicle / vessel shop. A party may deposit a bond equal to the amount of the bill for repairs and the clerk will issue a "Certificate of Release of Motor Vehicle."

90-Day Extension of Statute RE Medical Malpractice (FS §766.104(2))
Petitions for automatic 90-day extension of the statute of limitations to allow the reasonable investigation to determine if reasonable grounds exist for filing a Medical Malpractice lawsuit.

Release of Wrecker Operator's Lien (FS §713.78(13)(c)(3))
Process for posting cash or surety bond to discharge an undisputed wrecker operator lien which cannot be discharge by payment because the wrecker operator has moved or gone out of business. The posting of the bond allows the person to have their name removed from the list of persons who may not be issued a license plate or revalidation sticker for any motor vehicle.

Enforcement of Lien By Sale of Motor Vehicle (FS §713.585)
Filing process for a person claiming a lien for performing labor or services on a motor vehicle and may enforce the lien by sale of the vehicle. 

Guardianship Miscellaneous

This grouping includes the following types of records filed with the Clerk’s Office as provided by the cited Florida Statutes. 

Pre-Need Guardianship - Adult (FS §744.3045)
Written declaration filed by a competent adult naming a pre-need guardian to serve in the event of the declarant's incapacity.

Pre-Need Guardianship - Minor (FS §744.3046)
Written declaration filed by both parents, natural or adoptive, if living, or the surviving parent, that nominates a pre-need guardian of the person or property or both of the minor child if minor's last surviving parent becomes incapacitated or dies.

Professional Guardian (FS §744.3135)
Professional guardians file their fingerprint card criminal history record checks with the Clerk of the Court.

Probate Miscellaneous

This grouping includes the following types of records filed with the Clerk’s Office as provided by the cited Florida Statutes. 

Wills on Deposit (FS §732.901)
Wills deposited with the Clerk having venue of the estate of the decedent within 10 days after receiving information that the testator is dead.

Notice of Trust (FS §733.707(3))
Notice of Trust filed when any portion of a trust with respect to which a decedent who is the grantor, either alone or in conjunction with any other person, is liable for the expenses of the administration and obligations of the decedent's estate to the extent the decedent's estate is insufficient to pay them.

Caveat (By Creditor or Interested Person) (FS §731.110)
Caveats filed by any person, including a creditor, who is apprehensive that an estate, either testate or intestate, will be administered or that a will may be admitted to probate without the person's knowledge.
